On September 25, the National New Generation Artificial Intelligence Governance Professional Committee issued the "New Generation Artificial Intelligence Ethical Code" (hereinafter referred to as the "Ethical Code"), aiming to integrate ethics and morality into the entire life cycle of artificial intelligence, and provide ethical guidance for natural persons, legal persons and other related institutions engaged in artificial intelligence-related activities.

After special research, concentrated drafting, and soliciting opinions, the "Ethical Code" fully considers the current ethical concerns of all sectors of society regarding privacy, prejudice, discrimination, fairness, etc., including general principles, ethical norms for specific activities and organization and implementation.

The "Ethical Code" puts forward six basic ethical requirements, including improving human welfare, promoting fairness and justice, protecting privacy and security, ensuring controllability and credibility, strengthening responsibility, and improving ethical literacy. At the same time, 18 specific ethical requirements for specific activities such as artificial intelligence management, research and development, supply, and use were put forward.

In order to thoroughly implement the "Plan for the Development of New Generation Artificial Intelligence", refine and implement the "Principles for the Governance of New Generation Artificial Intelligence", enhance the ethical awareness and behavioral awareness of artificial intelligence in the whole society, actively guide responsible artificial intelligence research and development and application activities, and promote the healthy development of artificial intelligence, this specification is formulated.

Chapter 1 General Provisions

Article 1 This specification aims to integrate ethics into the entire life cycle of artificial intelligence, promote fairness, justice, harmony and security, and avoid prejudice, discrimination, privacy and information leakage.

Article 2 This specification applies to natural persons, legal persons and other related institutions engaged in related activities such as artificial intelligence management, research and development, supply, and use.

(1) Management activities mainly refer to the formulation and implementation of strategic planning, policies, regulations and technical standards related to artificial intelligence, resource allocation, supervision and review, etc.

(II) R&D activities mainly refer to scientific research, technology development, product development, etc. related to artificial intelligence.

(III) Supply activities mainly refer to the production, operation, sales, etc. related to artificial intelligence products and services.

(IV) Usage activities mainly refer to the procurement, consumption, operations, etc. related to artificial intelligence products and services.

Article 3 All types of artificial intelligence activities should follow the following basic ethical norms.

(I) Improve human welfare. Adhere to people-oriented, follow the common values ​​of mankind, respect human rights and fundamental interests of mankind, and abide by national or regional ethics and morality. Adhere to the priority of public interests, promote harmony and friendship between man and machine, improve people's livelihood, enhance a sense of gain and happiness, promote sustainable economic, social and ecological development, and jointly build a community with a shared future for mankind.

(2) Promote fairness and justice. Adhere to universality and inclusiveness, effectively protect the legitimate rights and interests of all relevant entities, promote the fair sharing of the benefits brought by artificial intelligence in the whole society, and promote social fairness, justice and equal opportunities. When providing artificial intelligence products and services, we should fully respect and help vulnerable groups and special groups, and provide corresponding alternatives as needed.

(III) Protect privacy and security. Fully respect the rights of personal information such as knowledge and consent, process personal information in accordance with the principles of lawfulness, legitimateness, necessity and integrity, protect personal privacy and data security, shall not damage the legal data rights and interests of individuals, shall not illegally collect and utilize personal information by means of stealing, tampering, and leakage, and shall not infringe upon personal privacy rights.

(IV) Ensure controllable and credible. Ensure that humans have full independent decision-making power, have the right to choose whether to accept services provided by artificial intelligence, have the right to withdraw from interaction with artificial intelligence at any time, and have the right to terminate the operation of artificial intelligence systems at any time, ensuring that artificial intelligence is always under human control.

(5) Strengthen responsibility. We must insist that human beings are the ultimate responsible subject, clarify the responsibilities of stakeholders, comprehensively enhance our sense of responsibility, reflect on ourselves and discipline in all links of the entire life cycle of artificial intelligence, establish an artificial intelligence accountability mechanism, and do not evade responsibility review, and do not evade responsibility.

(VI) Improve ethical literacy. Actively learn and popularize artificial intelligence ethical knowledge, objectively understand ethical issues, and do not underestimate or exaggerate ethical risks. Actively carry out or participate in discussions on artificial intelligence ethics issues, deeply promote the practice of artificial intelligence ethics governance, and improve response capabilities.

Article 4 Ethical norms that should be followed in specific activities of artificial intelligence include management specifications, R&D specifications, supply specifications and use specifications.

Chapter 2 Management Specifications

Article 5 Promote agile governance. Respect the laws of development of artificial intelligence, fully understand the potential and limitations of artificial intelligence, continuously optimize governance mechanisms and methods, and in the process of strategic decision-making, system construction, and resource allocation, we will not be divorced from reality, and do not seek instant benefits, and promote the healthy and sustainable development of artificial intelligence in an orderly manner.

Article 6 Active practice demonstration. Abide by relevant laws and regulations, policies and standards of artificial intelligence, actively integrate artificial intelligence ethics into the entire management process, take the lead in becoming a practitioner and promoter of artificial intelligence ethics governance, timely summarize and promote artificial intelligence governance experience, and actively respond to the society's ethical concerns about artificial intelligence.

Article 7: Correct exercise of rights. Clarify the responsibilities and power boundaries of management activities related to artificial intelligence, and standardize the conditions and procedures for the operation of power. Fully respect and protect the privacy, freedom, dignity, security and other rights and other legitimate rights and interests of relevant subjects, and prohibit improper exercise of power to infringe on the legitimate rights and interests of natural persons, legal persons and other organizations.

Article 8 Strengthen risk prevention. Enhance bottom-line thinking and risk awareness, strengthen the analysis and judgment of potential risks in the development of artificial intelligence, carry out systematic risk monitoring and evaluation in a timely manner, establish an effective risk warning mechanism, and improve the ability of artificial intelligence ethical risk management and handling.

Article 9 Promote inclusiveness and openness. We will fully attach importance to the rights and interests of all stakeholders of artificial intelligence, encourage the application of diversified artificial intelligence technology to solve practical problems in economic and social development, encourage interdisciplinary, cross-field, cross-regional and cross-border exchanges and cooperation, and promote the formation of a broad consensus artificial intelligence governance framework and standard norms.

Chapter 3 R&D Specifications

Article 10 Strengthen self-discipline awareness. Strengthen self-discipline in related activities of artificial intelligence research and development, actively integrate artificial intelligence ethics into all aspects of technology research and development, consciously carry out self-examination, strengthen self-management, and do not engage in artificial intelligence research and development that violates ethics.

Article 11 Improve data quality. In the data collection, storage, use, processing, transmission, provision, and disclosure, strictly abide by data-related laws, standards and specifications, and improve the completeness, timeliness, consistency, normativeness and accuracy of data.

Article 12 Enhance safety and transparency. In the algorithm design, implementation, application and other links, transparency, interpretability, understanding, reliability, and controllability are improved, resilience, adaptability and anti-interference capabilities of artificial intelligence systems are enhanced, and verified, supervised, traceable, predictable, and trustworthy are gradually realized.

Article 13 Avoid prejudice and discrimination. In data collection and algorithm development, we will strengthen ethical review, fully consider differentiated demands, avoid possible data and algorithm bias, and strive to achieve universality, fairness and non-discrimination of artificial intelligence systems.

Chapter 4 Supply Specifications

Article 14 Respect market rules. Strictly abide by various rules and regulations for market access, competition, trading and other activities, actively maintain market order, create a market environment conducive to the development of artificial intelligence, and do not destroy orderly market competition through data monopoly, platform monopoly, etc., and it is prohibited to infringe on the intellectual property rights of other entities by any means.

Article 15 Strengthen quality control. Strengthen the quality monitoring and use evaluation of artificial intelligence products and services, avoid personal safety, property safety, user privacy, etc. caused by design and product defects, and shall not operate, sell or provide products and services that do not meet quality standards.

Article 16 Protect users' rights and interests. Users should be clearly informed when using artificial intelligence technology in products and services, and the functions and limitations of artificial intelligence products and services should be identified to protect users' rights such as knowledge and consent. Provide users with simple and easy-to-understand solutions to choose to use or exit the AI ​​mode, and do not set obstacles to users' equal use of AI.

Article 17 Strengthen emergency support. Research and formulate emergency mechanisms and loss compensation plans or measures, timely monitor artificial intelligence systems, promptly respond to and process user feedback information, timely prevent systemic failures, and be ready to assist relevant entities in intervening in the artificial intelligence system in accordance with the law and regulations, reduce losses and avoid risks.

Chapter 5 Usage Specifications

Article 18 Promote good faith use. Strengthen the argumentation and evaluation of artificial intelligence products and services before use, fully understand the benefits brought by artificial intelligence products and services, fully consider the legitimate rights and interests of all stakeholders, and better promote economic prosperity, social progress and sustainable development.

Article 19 Avoid misuse and abuse. Fully understand the scope of application and negative impact of artificial intelligence products and services, and truly respect the rights of relevant entities to not use artificial intelligence products or services, avoid improper use and abuse of artificial intelligence products and services, and avoid unintentionally causing damage to the legitimate rights and interests of others.

Article 20: Violations and malicious uses are prohibited. It is prohibited to use artificial intelligence products and services that do not comply with laws and regulations, ethics and standards, it is prohibited to use artificial intelligence products and services to engage in illegal activities, it is strictly forbidden to endanger national security, public safety and production safety, and it is strictly forbidden to harm social public interests, etc.

Article 21: Timely and proactive feedback. Actively participate in the practice of artificial intelligence ethical governance, and provide timely feedback to relevant entities and assist in solving problems such as technical security loopholes, vacuum of policies and regulations, and lag in supervision found in the process of using artificial intelligence products and services.

Article 22 Improve the ability to use. Actively learn knowledge related to artificial intelligence, actively master the skills required in various usage links such as operation, maintenance, emergency response, etc. of artificial intelligence products and services, and ensure the safe use and efficient use of artificial intelligence products and services.

Chapter 6 Organization and Implementation

Article 23 This specification is issued by the National New Generation Artificial Intelligence Governance Professional Committee and is responsible for interpreting and guiding implementation.

Article 24 Management departments, enterprises, universities, research institutes, associations and other relevant institutions at all levels may formulate more specific ethical norms and related measures based on this specification and in combination with actual needs.

Article 25 This specification shall come into effect on the date of its promulgation and shall be revised in a timely manner according to the needs of economic and social development and the development of artificial intelligence.
